  • Welcome to the website of the Braude Academic College of Engineering in Karmiel (hereinafter “the Website“). The Website is owned and operated by the Braude Academic College of Engineering in Karmiel (hereinafter respectively “the Website“, “the College“).
  • The Website is used by the College employees/ those interested in studies/ students/ academics and the research community in Israel and around the world/ industry people (hereinafter “the User(s)”), within which the Users will be able to receive comprehensive information and service about the College’s services, and the study programs taught at the College (hereinafter “the College Services“).
  • Please be sure to review and update these Terms of Use (hereinafter “the Terms of Use“), since the very use of any User and/or person and/or entity that surfs and/or watches and/or otherwise uses the Website, directly or indirectly, including any content and/or service therein, constitutes consent on the part of the User to the Website’s Terms of Use, including the terms of the Privacy Policy (hereinafter “the Privacy Policy“) as will be updated from time to time, without prior notice and without any limitation and/or reservation. The Terms of Use and the Privacy Policy may change from time to time, in accordance with the complete and exclusive discretion of the College. Therefore, before performing any action on the Website, the User is requested to read, very carefully, the Terms of Use, including the Privacy Policy.
  • The wording of the Website’s Terms of Use, which is binding and determinative at any time, is the one published on the Website. The Terms of Use are cumulative and not reciprocal and will be interpreted as existing side by side and not detracting from each other. It is clarified that the User may choose to review some of the information and/or services offered on the Website and not all of them. Also, it is possible that some of the services offered on the Website are not active yet, and they will be available to the User when they are activated.

Prohibited uses on the Website

  • Use of the information provided during or in the context of the use of the Website. The use will be carried out in accordance with the provisions of the law and the Privacy Policy of the Website, which is an integral part of the Terms of Use.

  • The Website and the information that appears on it, including the Website design, drawings, designs, illustrations, music, photographs, images, maps, audio clips, video clips, text, graphics, etc. (hereinafter “the Content” or “the Contents“) are protected by copyright laws and intellectual property laws. The User is strictly prohibited from making changes, reverse engineering, copying, publishing, distributing, broadcasting, presenting, performing, duplicating, issuing a license, creating derivative works or selling any part of the Content contained on the Website without obtaining the express consent of the College, in advance and in writing.
  • All intellectual property rights in connection with the Website of any kind and type (whether it is registered rights or whether it is rights that have not yet been registered), including the domain name (“Domain“), patents, trademarks, trade names, models, copyrights, trade secrets, the methods, the way the Website is presented and designed, as well as any matter or detail related to the Website, are the exclusive property of the College or of a third party, which has allowed the College to use them, and the use of all said rights is permitted exclusively to the College (or to other third parties, if they have license to do so). No types of texts and/or codes and/or pictures and/or trademarks and/or photographs, and/or videos and/or any other content appearing on the Website shall be distributed, reproduced, sold, translated and/or any other action performed thereon, unless the College’s permission has been obtained to do so in advance in writing.
  • Without deviating from the aforementioned, the name of the College and its trademarks, including as they appear on the Website, are the exclusive property of the College and may not be used in any way.

Site content and advertisements

  • In the Terms of Use and the Privacy Policy, the term “Content” or “Contents”, means: any content, including but not limited to, text, links (hyperlinks), design, illustrations, photos, graphics, software, graphs, sound, video and/or audio clips etc.
  • The intention of the College is that the Content appearing on the Website will be true and accurate, however, the Content may not be complete and alternatively there may have been technical or other errors in the Content.
  • We use cookies to adjust the Website’s content especially for you. Continuing to browse the site constitutes consent to the use of cookies.
  • The Website displays Content, publications, articles, information, services and/or any other Content of the College (hereinafter “College Content“) and sometimes Content and services of third parties and/or on their behalf, (hereinafter “Third Party Content“) . It is clarified that any opinion, statement of position, advice, statement, proposal, information, service and/or any other content in the Third-Party Content, belong to that third party and the College is not involved in their creation, editing and/or activation.
  • It is recommended to carefully read the terms of use and the privacy policy of Third-Party Content before use, if they exist, and/or contact the owners of the linked websites in any case of a claim or request in this regard. It is further clarified that the College may, in accordance with its full and exclusive discretion, remove any link from the Website and/or add additional links and that the College does not guarantee that the links to the aforementioned websites will be active and will lead to an active website.
  • The use of Third-Party Content presented on the Website will be carried out at the sole responsibility of the User. The User will not have any assertion and/or demand and/or claim against the College in connection with the Content on the Website. Therefore, the College offers the User to carry out all his own assessments and tests regarding the service he is interested in purchasing, and in any case the User waives and will be precluded from raising any assertion and/or demand and/or claim in this regard.

Liability

  • The College does everything in its power to provide the User with a high-quality and safe user experience on the Website. However, the Website is not immune to glitches and/or problems and you may not have access to the Website from time to time.
  • The User knows that the Website, including any Content and/or service therein, are provided by the College in their condition as they are and subject to their availability (As Is and As Available) – including the information received by a third party. The College will not bear any liability, express or implied, in connection with the Website including any Content or service therein, as well as in connection with their suitability for a specific purpose and/or the User’s requirements.
  • The User hereby declares and undertakes that he is solely and fully responsible for any use he makes of the Website, including any Content and/or service therein, and that he knows that the College is not liable for the consequences, either directly or indirectly, relating to the User’s use of the Website, including monetary and non-monetary losses.

  • The User undertakes to compensate and indemnify the College and/or anyone on its behalf, immediately upon its first demand, for any damage, loss, loss of profit, payment and/or expense, damage to reputation, economic and/or commercial damage, including as a result of any demand , lawsuit, judgment, compromise, execution, including legal expenses, and the costs of legal advice, arising, directly and/or indirectly, from the violation of the Terms of Use and/or from any act and/or omission of the User and/or from any charge which the College and/or anyone on its behalf will be charged and for which, according to the Terms of Use, the College is not liable.
  • In any contradiction and/or inconsistency of any kind between any Content on the Website and the Terms of Use, including the Privacy Policy, the provisions of the Terms of Use and/or the Privacy Policy, as the case may be, shall prevail.

Website operating hours

  • The Website is active 24 hours a day, except for cases where the Website is down for maintenance and/or for any other reason.
  • It is hereby clarified that changes may apply to the dates specified in these Terms of Use, including Website activity hours and the like, all in accordance with the complete and exclusive discretion of the College.

Prescription

Without deviating from what is stated in the Terms of Use, the User is aware, agrees and hereby confirms that the prescription period regarding any assertion and/or demand and/or claim against the College will be limited to a period of six (6) months, and the parties consider this as an agreement for the prescription period as defined in section 19 of the Prescription Law, 5718-1958.

Jurisdiction and Choice of Law

For any use of the Website and/or for any assertion and/or demand and/or claim arising from this use and/or in connection with or arising from the College’s services and/or in any other matter directly or indirectly related to the Website, only the laws of the State of Israel shall apply. The exclusive jurisdiction in all matters related to and/or arising from these Terms of Use shall be given to the courts of the Haifa district and the subject matter and procedural law that shall apply shall be Israeli law.

Miscellaneous

  • These Terms of Use constitute the complete agreement between you and the College regarding the manner of using the Website and supersede any other understanding and/or agreement, oral or written, regarding the use of the Website and its Contents.
  • If a provision of the Terms of Use is found to be illegal, invalid or unenforceable for any reason, this provision will be deleted from the Terms of Use and its deletion will not affect the legality and validity of the remaining Terms of Use. In such a case, the existence of another similar term will be considered enforceable in place of the deleted or removed term.
  • Any delay, waiver, extension, deferral or avoidance on the part of the College to exercise its rights and/or in the requirement to meet any of these Terms of Use and/or its agreement to deviate from the Terms of Use shall not constitute a precedent, shall not be considered a waiver and/or consent on the part of the College and no inferrence shall be drawn to another case.
  • The Terms of Use detailed above do not create and will not be interpreted as creating any partnership, joint venture, employee-employer, agent or intermediary relationship between the User and the College.
